Estos Términos y Condiciones rigen el uso de LlaqtaMutur ("la Aplicación";
paquete Android com.gabo.llaqtamutur), del sitio
sicodata.pe/llaqtamutur y de los enlaces de viaje que la Aplicación genera.
Al instalar o usar cualquiera de ellos usted acepta estos Términos. Si no está de
acuerdo, no use la Aplicación.
These Terms and Conditions govern the use of LlaqtaMutur ("the App";
Android package com.gabo.llaqtamutur), the site
sicodata.pe/llaqtamutur, and the trip links the App generates. By installing or
using any of them you accept these Terms. If you do not agree, do not use the
App.
El tratamiento de sus datos se rige por la Política de Privacidad, que forma parte de estos Términos.
The handling of your data is governed by the Privacy Policy, which forms part of these Terms.
LlaqtaMutur es una herramienta de orientación informativa sobre el transporte público de Lima. Sugiere rutas, dibuja recorridos, estima tiempos y muestra avisos que reportan otras personas.
LlaqtaMutur is an informational guidance tool for public transit in Lima. It suggests routes, draws itineraries, estimates times, and shows reports submitted by other people.
Para publicar contenido hace falta iniciar sesión con Google. Usted es responsable del uso que se haga de su cuenta. El seudónimo que elija es el único nombre que la Aplicación muestra a otras personas; puede cambiarlo una vez cada 30 días. Debe cumplir la política de contenido de la sección 4: no puede suplantar a autoridades, empresas ni personas reales, ni contener datos de contacto ni insultos.
Publishing content requires signing in with Google. You are responsible for the use made of your account. The pseudonym you choose is the only name the App shows to other people; you may change it once every 30 days. It must comply with the content policy in section 4: it may not impersonate authorities, companies, or real people, nor contain contact details or insults.

La Aplicación permite publicar reportes de eventos, mensajes en el tablón de la comunidad y respuestas. Usted es el único responsable de lo que publique. Está prohibido:
The App lets you publish event reports, community board messages, and replies. You are solely responsible for what you publish. The following is prohibited:
Cada mensaje del tablón lleva un menú con Reportar y Bloquear. Revisamos lo reportado y podemos retirar contenido o suspender cuentas sin aviso previo cuando incumplan estas normas. Al publicar, usted nos concede una licencia no exclusiva, gratuita y mundial para mostrar ese contenido dentro de la Aplicación y de los enlaces que genere; usted conserva la titularidad.
Every board message has a menu with Report and Block. We review reported content and may remove content or suspend accounts without prior notice when these rules are breached. By publishing, you grant us a non-exclusive, royalty-free, worldwide license to display that content within the App and the links it generates; you retain ownership.
Cuando usted pulsa "Compartir", la Aplicación crea un enlace que muestra su posición en tiempo real y el recorrido de ese viaje. Ese enlace se abre sin cuenta y sin contraseña: cualquiera que lo tenga ve dónde está usted mientras el viaje siga en curso. Usted decide a quién se lo envía y puede cortarlo en cualquier momento finalizando el viaje. No nos hacemos responsables de su reenvío a terceros.
When you tap "Share", the App creates a link showing your real-time position and that trip's route. That link opens without an account or password: anyone who has it can see where you are while the trip is running. You decide who you send it to and you can cut it off at any time by ending the trip. We are not responsible for it being forwarded to third parties.
La Aplicación y el sitio muestran publicidad de Google (AdMob y AdSense), que es lo que permite ofrecerlos sin costo. No controlamos qué anuncio concreto se muestra ni respondemos por los productos, servicios o sitios de los anunciantes. Su tratamiento de datos publicitarios se describe en la sección 5 de la Política de Privacidad.
The App and the site display Google advertising (AdMob and AdSense), which is what allows them to be offered free of charge. We do not control which specific ad is shown and we are not liable for advertisers' products, services, or sites. Advertising data handling is described in section 5 of the Privacy Policy.
LEA CON ATENCIÓN. La Aplicación se proporciona "TAL CUAL" y "SEGÚN DISPONIBILIDAD", sin garantía de ningún tipo, expresa o implícita, incluidas —sin limitarse a ellas— las garantías implícitas de comerciabilidad, idoneidad para un propósito determinado, exactitud, disponibilidad continua y no infracción. Usted usa la Aplicación por su propia cuenta y riesgo y asume la responsabilidad por las decisiones que tome a partir de la información que le muestre.
READ CAREFULLY. The App is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including — but not limited to — the implied warranties of merchantability, fitness for a particular purpose, accuracy, continuous availability, and non-infringement. You use the App at your own risk and you assume responsibility for the decisions you make based on the information it shows you.
En particular, usted entiende y acepta que la Aplicación no sustituye su propio criterio al desplazarse por la ciudad, y que no debe manipular el teléfono mientras conduce ni en situaciones que requieran su atención.
In particular, you understand and accept that the App does not replace your own judgement when moving around the city, and that you must not operate the phone while driving or in situations that require your attention.
La Aplicación no es un servicio de emergencia, de seguridad personal ni de localización de personas, y no debe usarse como tal. La alarma de llegada, el enlace compartido y las notificaciones dependen de la batería, de la cobertura, de los permisos concedidos y de las restricciones de ahorro de energía del fabricante de su teléfono: pueden no funcionar, llegar tarde o dejar de actualizarse sin aviso. Ante una emergencia, llame a los servicios correspondientes.
The App is not an emergency, personal-safety, or people-locating service and must not be used as one. The arrival alarm, the shared link, and notifications depend on battery, coverage, granted permissions, and your phone manufacturer's power-saving restrictions: they may fail, arrive late, or stop updating without notice. In an emergency, call the appropriate services.
La Aplicación depende de servicios operados por terceros — entre otros Google (Firebase, Play services, AdMob), Cloudflare, OpenStreetMap, Nominatim, Photon (komoot), OSRM y CARTO —. No controlamos su disponibilidad, exactitud ni continuidad, y no respondemos por sus interrupciones, errores o cambios, ni por que alguno deje de prestarse. The App depends on services operated by third parties — including Google (Firebase, Play services, AdMob), Cloudflare, OpenStreetMap, Nominatim, Photon (komoot), OSRM, and CARTO —. We do not control their availability, accuracy, or continuity, and we are not liable for their outages, errors, or changes, nor for any of them ceasing to operate. La Aplicación se ofrece sin costo y no genera derecho a compensación alguna a favor del usuario. En la máxima medida permitida por la ley aplicable, Sicodata Peru y sus colaboradores no serán responsables de daños directos, indirectos, incidentales, especiales, punitivos o consecuentes — incluidos, sin limitación, pérdida de tiempo, pérdida de oportunidad, pérdida de ingresos, gastos de transporte alternativo, daño a bienes, daño moral, o daños derivados de llegar tarde, tomar un vehículo equivocado, bajarse en un lugar equivocado o confiar en un aviso inexacto de otro usuario — aunque se hubiera advertido de la posibilidad de tales daños.
The App is offered free of charge and does not give rise to any right to compensation in favor of the user. To the maximum extent permitted by applicable law, Sicodata Peru and its contributors shall not be liable for direct, indirect, incidental, special, punitive, or consequential damages — including, without limitation, loss of time, loss of opportunity, loss of income, alternative transport costs, damage to property, moral damages, or damages arising from arriving late, boarding the wrong vehicle, getting off at the wrong place, or relying on another user's inaccurate report — even if advised of the possibility of such damages.
Límite máximo. Si pese a lo anterior se determinara alguna responsabilidad, esta quedará limitada al monto que usted haya pagado por la Aplicación en los doce meses anteriores al hecho, que por ser gratuita es cero (US$ 0,00).
Maximum cap. If liability is nonetheless established, it shall be limited to the amount you paid for the App in the twelve months preceding the event, which — the App being free — is zero (US$ 0.00).
Nada en estos Términos excluye ni limita la responsabilidad que no pueda excluirse legalmente: dolo, culpa inexcusable, daños a la vida o la integridad de las personas, ni los derechos que el Código de Protección y Defensa del Consumidor del Perú (Ley N.º 29571) reconoce de forma irrenunciable a los consumidores. Si una autoridad competente declarara inválida o abusiva alguna cláusula, las demás siguen en vigor y aquella se aplicará en la medida máxima que la ley permita.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded: willful misconduct, gross negligence, harm to life or personal integrity, or the rights that Peru's Consumer Protection and Defense Code (Law No. 29571) grants consumers on a non-waivable basis. If a competent authority declares any clause invalid or abusive, the remaining clauses stay in force and that clause shall apply to the maximum extent the law permits.
Podemos modificar, suspender o descontinuar la Aplicación, en todo o en parte, en cualquier momento y sin aviso previo, sin que ello genere obligación ni compensación alguna. Podemos actualizar estos Términos; la fecha de la última actualización figura arriba y el uso posterior de la Aplicación supone su aceptación. Si un cambio es sustancial, procuraremos avisarlo dentro de la propia Aplicación.
We may modify, suspend, or discontinue the App, in whole or in part, at any time and without prior notice, without this giving rise to any obligation or compensation. We may update these Terms; the last-updated date appears above and continued use of the App constitutes acceptance. If a change is substantial, we will endeavor to announce it within the App itself.
El nombre LlaqtaMutur, su logotipo, su interfaz y su código son de Sicodata Peru. La Aplicación incorpora software y datos de terceros bajo sus propias licencias — entre ellas ODbL para los datos de OpenStreetMap y Apache 2.0 y BSD para las bibliotecas —; todo ello se detalla en Licencias, dentro de la Aplicación en Configuración → Agradecimientos.
The LlaqtaMutur name, logo, interface, and code belong to Sicodata Peru. The App incorporates third-party software and data under their own licenses — including ODbL for OpenStreetMap data and Apache 2.0 and BSD for the libraries —; all of it is listed at Licenses and, within the App, at Settings → Acknowledgements.
Estos Términos se rigen por las leyes de la República del Perú. Cualquier controversia se someterá a los jueces y tribunales de Lima, Perú, sin perjuicio de los fueros que la ley de protección al consumidor reserve al consumidor.
These Terms are governed by the laws of the Republic of Peru. Any dispute shall be submitted to the courts of Lima, Peru, without prejudice to any venue that consumer-protection law reserves for the consumer.
